WHO QUALIFIES?

While many sites qualify, eligibility for the Massachusetts Brownfields Tax Credit program is limited in several important ways. Some of the eligibility criteria include:
 
 

The site property must be used for commercial purposes (owner-occupied residential property is not eligible)
 

The property must be located in a city or town designated as an Economically Distressed Area, or EDA.
 

You must be or have been the owner, operator, or tenant of the property at the time of the spending
 

You cannot be responsible for the contamination (generally, this means that the contamination originated prior to your ownership or use of the property)
 

The work was conducted pursuant to the Massachusetts Contingency Plan (MCP), generally under the direction of a Licensed Site Professional (LSP)
 

Your spending must exceed a minimum threshold based on the property value
 

The work must have been conducted since 1998.

Typical tax credit recipients include commercial property owners, small businesses, developers, not-for-profit organizations including community development corporations (CDCs), colleges and universities, and private school operators. These parties may qualify if they took steps to investigate or remediate pre-existing contamination that was from a prior use of the site, related to an off-site release that migrated onto the property, the result of historic fill or past practices, or a release that occurred prior to your purchase of the property, whether known or unknown at the time of purchase.

What costs might qualify? Any costs incurred to assess, contain, remove, or otherwise respond to the contamination may be eligible for recovery. These costs typically include Licensed Site Professional (LSP) services, engineering costs, contractor expenses related to the cleanup, laboratory analyses and testing, DEP and other agency fees, and others.
